School punishes Filipino boys for Facebook kissing

(AP) ? A Philippine Catholic school is withholding the diplomas of six high school boys who uploaded Facebook photos that appear to show them kissing one another, an education official said Friday.

A day earlier, a Philippine court rejected another Catholic school's decision to bar five girls from graduation ceremonies because they had posed in bikinis for photos posted on Facebook. The cases test the limits of privacy in a conservative Catholic nation that is also among the world's most prolific users of social networking sites.

Department of Education officer Samuel Mergenio said the six boys told him they had taken prank photos to make it appear that their lips touched. One of the boys uploaded the pictures on Facebook and mistakenly made them available to others, Mergenio said.

The pictures were not taken at the boys' school, Infant Jesus Academy in the Manila suburb of Marikina, but the students were wearing school uniforms, he said.

Mergenio said the school's chancellor informed the department late Thursday that the boys will be allowed to participate in the graduation ceremonies but "the release of their diplomas will be delayed." He said the school did not say when the diplomas will be handed over and that he was awaiting a formal written report from the school.

The school chancellor was not available for comment Friday.

The mother of the boy who uploaded the photos said she works as a nurse in Saudi Arabia and went home only to attend the graduation of her son, one of twins.

She said she refused to attend the graduation ceremonies because her son would only be subjected to ridicule since he won't be called to the stage to receive his diploma. "It will be like an insult," she told The Associated Press.

On Thursday, a judge in central Cebu city issued a restraining order against St. Theresa's College High School, ordering it to allow the five students who appeared in the bikini photos to take part in Friday afternoon's graduation ceremonies.

The school, which declined to comment to the AP, asked the court to reconsider. The girls' lawyer, Cornelio Mercado, said Friday that the school was still insisting on banning the students while its motion for reconsideration is pending.

Mercado said one Facebook photo at issue showed a girl holding a cigarette and a liquor bottle, while others showed all five wearing bikinis at a beach party on the 16th birthday of one the girls in late December.

The mother of the girl who hosted the party said a security guard barred the group Friday from entering the school campus.

"They were really hurt," she said.

School officials took action against the girls for what they called "engaging in immoral, indecent, obscene or lewd acts," according to court records. They said the students would graduate but could not participate in activities or ceremonies.

Earlier this month, the five girls were summoned by the principal and other school officials, "dressed down" and called "sluts," Mercado said.

The judge, Wilfredo Navarro of the Regional Trial Court, castigated school officials for calling the girls "inappropriate names." He said not allowing them to participate in graduation activities "would indeed be most un-Christian if not entirely inhuman."

We're spending?more ? and saving less

The daffodils are up, the job and housing markets are improving, businesses are more upbeat and consumers are getting back in a spending mood.

Unfortunately, American households are dipping into savings and tapping credit cards to pay for their latest shopping spree. Unless their paychecks begin expanding at the same pace, the new?spending, and the boost it's giving to the economy, may not be sustainable.

"While households want to spend and will raid their bank accounts to support that habit, unless income gains start improving consumption will have to slow," said Joel Naroff, chief economist at Naroff Ecoomic Advisors.

After a long, slow recovery from the 2007 recession, consumers are feeling more upbeat about the economic outlook in 2012. Five years after the worst housing collapse since the Great Depression, home prices in many markets are beginning to stabilize and sales are perking up. The job market, though still very tight in?many industries and occupations, has been creating new openings at a healthy clip. The stock market is up nearly 30 percent in the past six months.

All of which?helped boost consumer confidence to its highest level in more than a year in March, according to the latest reading by Thomson Reuters and University of Michigan. The upbeat mood has been showing up in other consumer surveys.

It's also showing up in the data on consumer spending, which rose 0.8 percent, according to the Commerce Department. Spending on durable goods like cars and trucks rose sharply. January's spending was revised up to 0.4 percent from a previously reported 0.2 percent gain.

The spending gains have also helped boost wider optimism about the economy and has prompted some forecasters to lift their estimates for the pace of growth this year.

"So long as the consumer is spending, that's the biggie everyone is watching as they drive the economy," said Wayne Kaufman, chief market analyst at John Thomas Financial.

Not all of the spending boost came from increased confidence. Higher gasoline prices have forced households to shell out more at the pump even if their paychecks are able to stretch far enough to make up the difference. The energy component of the Commerce Department's spending data surged 3.6 percent last month, largely due to higher gasoline prices, which have jumped 62 percent so far this year.

?Some forecasters think the pain at the pump will get worse before it gets better.

"The bad news is that pump prices will start approaching the $4.15-$4.20 per gallon range by Memorial Day," said Chris Christopher, a senior economist at IHS Global Insight. "The good news is that a relatively stronger job and stock market are assisting in holding up consumer spending and confidence."

After several false starts, the job market seems to be gaining strength, adding nearly 250,000 jobs a month for the last three months, helping to bring the unemployment rate down?to 8.3 percent from 9.0 percent in September.

Some small business owners are report that they plan to hire this year. About a third of those surveyed by payroll processor Sure Payroll said they plan to take on more workers in 2012, with only two percent planning layoffs. The rest expect to keep staffing levels where they are. Nearly 80 percent of those polled said the pace of business met or exceeded their expectations in the first three months of this year.

The hope is that continued improvement in the job market will translate into higher wages, which would help sustain the recent pickup in spending. Until then, consumers are leaning on their savings and credit cards to pay for the spending increase. Personal income inched up just 0.2 percent last month;?disposable income, the amount left after taxes and inflation, fell for a second straight month,

That means dipping into savings and borrowing more. The savings rate, the amount of disposable income households have socked away, dropped to 3.7 percent, the lowest rate since August.

After steadily declining during the recession, the total level of revolving credit outstanding bottomed in May 2010 and is up 8.3 percent since them, according to the latest data from the Federal Reserve.

CNBC's Rick Santelli has the consumer sentiment data, which jumped to 76.2 vs. 75.3 in February.

West Antarctic ice shelves tearing apart at the seams

ScienceDaily (Mar. 27, 2012) ? A new study examining nearly 40 years of satellite imagery has revealed that the floating ice shelves of a critical portion of West Antarctica are steadily losing their grip on adjacent bay walls, potentially amplifying an already accelerating loss of ice to the sea.

The most extensive record yet of the evolution of the floating ice shelves in the eastern Amundsen Sea Embayment in West Antarctica shows that their margins, where they grip onto rocky bay walls or slower ice masses, are fracturing and retreating inland. As that grip continues to loosen, these already-thinning ice shelves will be even less able to hold back grounded ice upstream, according to glaciologists at The University of Texas at Austin's Institute for Geophysics (UTIG).

Reporting in the Journal of Glaciology, the UTIG team found that the extent of ice shelves in the Amundsen Sea Embayment changed substantially between the beginning of the Landsat satellite record in 1972 and late 2011. These changes were especially rapid during the past decade. The affected ice shelves include the floating extensions of the rapidly thinning Thwaites and Pine Island Glaciers.

"Typically, the leading edge of an ice shelf moves forward steadily over time, retreating episodically when an iceberg calves off, but that is not what happened along the shear margins," says Joseph MacGregor, research scientist associate and lead author of the study. An iceberg is said to calve when it breaks off and floats out to sea.

"Anyone can examine this region in Google Earth and see a snapshot of the same satellite data we used, but only through examination of the whole satellite record is it possible to distinguish long-term change from cyclical calving," says MacGregor.

The shear margins that bound these ice shelves laterally are now heavily rifted, resembling a cracked mirror in satellite imagery until the detached icebergs finally drift out to the open sea. The calving front then retreats along these disintegrating margins. The pattern of marginal rifting and retreat is hypothesized to be a symptom, rather than a trigger, of the recent glacier acceleration in this region, but this pattern could generate additional acceleration.

"As a glacier goes afloat, becoming an ice shelf, its flow is resisted partly by the margins, which are the bay walls or the seams where two glaciers merge," explains Ginny Catania, assistant professor at UTIG and co-author of the study. "An accelerating glacier can tear away from its margins, creating rifts that negate the margins' resistance to ice flow and causing additional acceleration."

The UTIG team found that the largest relative glacier accelerations occurred within and upstream of the increasingly rifted margins.

The observed style of slow-but-steady disintegration along ice-shelf margins has been neglected in most computer models of this critical region of West Antarctica, partly because it involves fracture, but also because no comprehensive record of this pattern existed. The authors conclude that several rifts present in the ice shelves suggest that they are poised to shrink further.

WASHINGTON (AP) ? President Barack Obama's health care overhaul is front and center at the Supreme Court for three days of hearings to determine the fate of a law aimed at extending health insurance to more than 30 million Americans.

The justices will hear arguments beginning Monday in a highly partisan legal fight between the Obama administration and the 26 states that are leading a challenge to the largest expansion in the nation's social safety net in more than four decades.

A decision is expected by late June, in the midst of a presidential election campaign in which all of Obama's Republican challengers oppose the law and promise its repeal, if the high court doesn't strike it down first.

People hoping for a glimpse of the action have waited in line all weekend for the relatively few seats open to the public. The justices allotted the case six hours of argument time, the most since the mid-1960s.

The court will release audio recordings of the arguments on the same day they take place. The first time that happened was when the court heard argument in the Bush v. Gore case that settled the 2000 presidential election. The last occasion was the argument in the Citizens United case that wound up freeing businesses from longstanding limits on political spending.

Outside groups filed a record 136 briefs on various aspects of the court case.

The first arguments Monday concern whether the challenge is premature under a 19th century tax law because the insurance requirement doesn't kick in until 2014 and people who remain uninsured wouldn't have to pay a penalty until they file their 2014 income taxes in early 2015.

Taking this way out of the case would relieve the justices of rendering a decision in political high season, just months before the presidential election.

The biggest issue before the court is Tuesday's argument over the constitutionality of the individual insurance requirement. The states and the National Federation of Independent Business say Congress lacked authority under the Constitution for its unprecedented step of forcing Americans to buy insurance whether they want it or not.

The administration argues Congress has ample authority to do what it did. If its action was rare, it is only because Congress was dealing with a problem that has stymied Democratic and Republican administrations for many decades: How to get adequate health care to as many people as possible, and at a reasonable cost.

The justices also will take up whether the rest of the law can remain in place if the insurance mandate falls and, separately, whether Congress lacked the power to expand the Medicaid program to cover 15 million low-income people who currently earn too much to qualify.

If upheld, the law will force dramatic changes in the way insurance companies do business, including forbidding them from denying coverage due to pre-existing medical conditions and limiting how much they can charge older people.

The law envisions that insurers will be able to accommodate older and sicker people without facing financial ruin because of its most disputed element, the requirement that Americans have insurance or pay a penalty.

By 2019, about 95 percent of the country will have health insurance if the law is allowed to take full effect, the Congressional Budget Office estimates.

Reams of court filings attest that the changes are being counted on by people with chronic diseases, touted by women who have been denied coverage for their pregnancies, and backed by Americans over 50 but not yet old enough to qualify for Medicare, who face age-inflated insurance premiums.

Republicans are leading the fight to kill the law either by the court or through congressional repeal. They say the worst fears about what they derisively call "Obamacare" already have come to pass in the form of higher costs and regulations, claims that the law's supporters dispute.

The White House says it has little doubt the high court will uphold the law, and that even its opponents will eventually change their tune.

"One thing I'm confident of is, by the end of this decade, we're going to be very glad the Republicans termed this 'Obamacare,' because when the reality of health care is in place, it's going to be nothing like the kind of fear-mongering that was done," said David Plouffe, a senior adviser to the president, said Sunday in an interview with ABC's "This Week."

Polls have consistently shown the public is at best ambivalent about the benefits of the health care law, and that a majority of Americans believe the insurance requirement is unconstitutional.

Researchers find gene that can transform mild influenza to a life-threatening disease

A genetic finding could help explain why influenza becomes a life-threating disease to some people while it has only mild effects in others. New research led by the Wellcome Trust Sanger Institute has identified for the first time a human gene that influences how we respond to influenza infection.

People who carry a particular variant of a gene called IFITM3 are significantly more likely to be hospitalised when they fall ill with influenza than those who carry other variants, the team found. This gene plays a critical role in protecting the body against infection with influenza and a rare version of it appears to make people more susceptible to severe forms of the disease. The results are published in the journal Nature.

A central question about viruses is why some people suffer badly from an infection and others do not. IFITM3 is an important protein that protects cells against virus infection and is thought to play a critical role in the immune system's response against such viruses as H1N1 pandemic influenza, commonly known as 'swine flu'. When the protein is present in large quantities, the spread of the virus in lungs is hindered, but if the protein is defective or absent, the virus can spread more easily, causing severe disease.

"Although this protein is extremely important in limiting the spread of viruses in cells, little is known about how it works in lungs," explains Aaron Everitt, first author from the Wellcome Trust Sanger Institute. "Our research plays a fundamental part in explaining how both the gene and protein are linked to viral susceptibility."

The antiviral role of IFITM3 in humans was first suggested by studies using a genetic screen, which showed that the protein blocked the growth of influenza virus and dengue virus in cells. This led the team to ask whether IFITM3 protected mice from viral infections. They removed the IFITM3 gene in mice and found that once they contracted influenza, the symptoms became much more severe compared to mice with IFITM3. In effect, they found the loss of this single gene in mice can turn a mild case of influenza into a fatal infection.

The researchers then sequenced the IFITM3 genes of 53 patients hospitalised with influenza and found that some have a genetic mutant form of IFITM3, which is rare in normal people. This variant gene encodes a shortened version of the protein which makes cells more susceptible to viral infection.

"Since IFITM3 appears to be a first line defender against infection, our efforts suggest that individuals and populations with less IFITM3 activity may be at increased risk during a pandemic and that IFITM3 could be vital for defending human populations against other viruses such as avian influenza virus and dengue virus" says Dr. Abraham Brass, co-senior author and Assistant Professor at the Ragon Institute and Gastrointestinal Unit of Massachusetts General Hospital.

This research was a collaboration between institutes in the United States and the United Kingdom. The samples for this study were obtained from the MOSAIC consortium in England and Scotland, co-ordinated from the Centre for Respiratory Infection (CRI) at Imperial College London, and the GenISIS consortium in Scotland at the Roslin Institute of the University of Edinburgh. These were pivotal for the human genetics component of the work.

"Collectively, these data reveal that the action of a single antiviral protein, IFITM3, can profoundly alter the course of the flu and potentially other viruses in both human and mouse," explains Professor Paul Kellam, co-senior author from the Wellcome Trust Sanger Institute. "To fully understand how both the protein and gene control our susceptibility to viral infections, we need to study the mechanisms of the gene variant more closely.

"Our research is important for people who have this variant as we predict their immune defences could be weakened to some virus infections. Ultimately as we learn more about the genetics of susceptibility to viruses, then people can take informed precautions, such as vaccination to prevent infection."

Sir Mark Walport, director of the Wellcome Trust, said: "During the recent swine flu pandemic, many people found it remarkable that the same virus could provoke only mild symptoms in most people, while, more rarely, threatening the lives of others. This discovery points to a piece of the explanation: genetic variations affect the way in which different people respond to infection.

"This important research adds to a growing scientific understanding that genetic factors affect the course of disease in more than one way. Genetic variations in a virus can increase its virulence, but genetic variations in that virus's host us matter greatly as well."
